TitanGiveaway – Competition Terms and Conditions

1. Introduction

1.1 Promoter: These Terms and Conditions (“Terms”) apply to all prize competitions (“Competitions”) operated by TITANGIVEAWAY LTD (“the Promoter”), a company registered in the United Kingdom. By entering any Competition on the TitanGiveaway website (the “Website”), you (“Entrant” or “you”) agree to be bound by these Terms.

1.2 Legal Nature: The Competitions are prize competitions/free draws intended to comply with applicable UK laws (including the Gambling Act 2005)

. No gambling license is required, as each Competition either involves a degree of skill or provides a free entry route, meaning it is not an illegal lottery

No purchase is necessary to enter; a free entry method is available (see Section 3.2). Paying for entries does not increase your chances of winning

. All entries, whether paid or free, are treated equally in the winner selection

1.3 Applicable Terms: Each Competition may have specific details or rules stated on its respective page on the Website (such as prize details, ticket price, and closing date). These Terms apply in addition to any such Competition-specific details. In the event of any conflict, these general Terms will prevail unless the specific rules expressly state otherwise.

1.4 Acceptance: By entering any Competition, you confirm that you meet the eligibility requirements (Section 2) and that you have read and understood these Terms. If you do not agree, you should not enter the Competitions. The Promoter reserves the right to disqualify or refuse entry to any Entrant who breaches these Terms.

2. Eligibility

2.1 Age Requirement: Competitions are open only to individuals aged 18 years or over. Entrants may be required to provide proof of age (such as a valid government ID) before being declared a winner. Entries from persons under 18 will be void.

2.2 Personal Eligibility: Employees, directors, and agents of the Promoter, any of its parent or subsidiary companies, and any persons professionally connected with the Competitions (including family members of such persons) are not eligible to enter. The Promoter reserves the right to verify eligibility and to exclude anyone found to be in breach of this provision.

2.3 Geographic Restrictions: The Competitions are open to entrants worldwide except in jurisdictions where such prize competitions are prohibited or restricted by law. Entries will NOT be accepted from any jurisdiction where entry would be unlawful or require registration with local authorities. Without limitation, this includes the United States of America, Canada (excluding Quebec), and any other country, state, or region where prize competitions of this nature are illegal or require a license or permit. It is your responsibility to check your local laws before entering.

2.4 Compliance with Local Law: Entrants are solely responsible for ensuring that participating in the Competitions is legal in their country or jurisdiction of residence. By entering, you represent and warrant that your entry does not violate any local law or regulation. The Promoter will not be liable if you enter a Competition unlawfully. Entries deemed unlawful in any jurisdiction are void. If an Entrant is disqualified on these grounds after winning, the prize will be forfeited and an alternate winner will be drawn.

2.5 One Account: Each Entrant must enter using a single, unique account on the Website. Multiple accounts per person are not permitted. The Promoter may disqualify any Entrant suspected of using multiple identities, email addresses, or any automated system to enter (see Section 3.4 on entry limits). All entries must be made directly by the individual entering the Competition.

2.6 Void Where Prohibited: These Competitions are void where prohibited by law

. The Promoter reserves the right to refuse any entry at its discretion if it has reason to believe that accepting such entry would contravene the laws of the Entrant’s jurisdiction.

 

3. How to Enter

Participants may enter each Competition via one of the two methods described below. No purchase is necessary to participate. The availability of a paid entry route and a free entry route for each Competition is intended to ensure compliance with UK law and to give all Entrants an equal opportunity

3.1 Paid Entry (Ticket Purchase)

  • Website Entry: To enter via paid purchase, visit the TitanGiveaway Website and select the Competition you wish to enter. You will be required to create an account or log in, and provide requested details (such as name, email, address, etc.) for contact purposes


    . Follow the on-screen instructions to purchase an entry ticket (or multiple tickets, if allowed) for the Competition. Each ticket corresponds to a chance to win the prize. The price of entry (ticket cost) and maximum number of entries per person (if any) will be stated on the Competition page.

     

  • Skill Question: As part of the entry process, you may be required to answer a question or complete a task to demonstrate skill, knowledge, or judgement. For example, you might need to answer a multiple-choice question about a topic related to the prize. You must answer the question correctly to qualify for the prize draw. (All paid entrants who answer the question correctly will be entered into the random draw for the winner. Incorrect answers will not be entered, and the entry fee will be refunded or the entry invalidated in accordance with the Competition rules.) The Promoter reserves the right to change the competition question if necessary; any entries with previously correct answers would remain valid.

  • Confirmation: After completing the purchase (and answering any required question correctly), you will receive an order confirmation and entry number(s) via email or via your online account. Please note: Receipt of a confirmation or entry number does not guarantee that your entry is eligible; all entries remain subject to verification of eligibility and compliance with these Terms. The Promoter may reject or disqualify any entry that is found to violate the Terms or the specific Competition rules (with a refund provided for any entry fee, if applicable).

  • No Advantage for Purchase: Purchasing entries does not confer any advantage over free entries in the drawing. Every valid entry, whether obtained via purchase or via the free route, has an equal chance of winning in the random draw.

    . Multiple entries: Unless a specific limit is stated on the Competition page, Entrants may purchase multiple tickets if desired (subject to any maximum entries per person the Promoter sets for that Competition). All entries must be made in accordance with these Terms.

     

3.2 Free Entry (No Purchase Necessary)

  • Free Entry Route: For each Competition, the Promoter offers a free entry method with no purchase necessary. To enter for free, Entrants must submit an entry by postal mail (or via the online free entry form, if provided for a particular Competition). Postal Entry: Send a postcard or letter to the Promoter at TitanGiveaway Ltd – Free Entry, . Your mailed entry must include: (a) the name of the Competition you wish to enter, (b) your full name, date of birth, and full postal address, (c) your email address and phone number (so we can contact you if you win), and (d) the answer to the Competition question (if a skill question is required for that Competition). Incomplete or illegible free entries will be disqualified.

  • Free Online Entry (if available): If the Promoter provides an online free entry form on the Website (e.g., via a “Free Entry” page or form submission), you may alternatively submit your free entry through that form, providing the same information as listed above. The Promoter will publish and promote the free entry route to ensure it is visible and equally accessible alongside the paid route

    . (If no online form is provided, the postal method must be used.)

     

    Equal Treatment: Free entries are processed in the same manner as paid entries and carry no disadvantage. They are entered into the same pool for the random draw and are indistinguishable in the selection process

    . There is no charge to enter via the free route aside from normal postage costs (and the Promoter does not charge any fee for processing free entries).

     

  • Free Entry Limits: Limit one (1) free entry per person per Competition, unless otherwise specified. Additional free entries beyond the first per Competition (for example, duplicate mail entries from the same person for the same Competition) will be disregarded. The Promoter reserves the right to disqualify entrants who attempt to abuse the free entry route by submitting bulk entries under different names or addresses. Bulk or automated entries from trade, consumer groups, or third-party entry services will not be accepted. Each free entry must be submitted individually by the person entering.

  • Deadlines for Free Entry: Postal free entries must be received by the Promoter no later than the announced closing date for the Competition (see Section 4.1). It is your responsibility to mail your entry with sufficient time for delivery. Proof of posting is not proof of receipt. The Promoter is not responsible for any free entries lost, delayed, or misdelivered (e.g., due to postal service issues). If a free online entry method is available, it will likewise have a deadline (closing time on the closing date) by which the form must be submitted. Late entries will not be entered.

  • Confirmation of Free Entries: The Promoter does not typically send confirmation for free postal entries. Free entries will be recorded internally once received and processed. All free entries received in time that meet the requirements will be included in the random draw with equal chance. If you wish to confirm that your free entry was included, you may contact the Promoter after the winner announcement for that Competition to inquire (however, the Promoter cannot guarantee individual acknowledgment of each free entry due to volume).

4. Competition Period and Drawing

4.1 Closing Date: Each Competition will have a specified closing date and/or time, which will be stated on the Website’s page for that Competition. No entries (paid or free) will be accepted after the closing date/time. The Promoter reserves the right to extend the closing date for a reasonable period or close the Competition early, in its sole discretion, where circumstances require (for example, if a technical problem occurs, or if insufficient entries have been received by the initial closing date). Any such changes will be communicated on the Website and/or via email to entrants. Once the extended deadline passes or the Competition is closed, no further entries will be accepted.

4.2 Entry Cap: Some Competitions may have a maximum number of entries or tickets available. This will be indicated on the Competition page if applicable. If the Competition sells out (i.e., all available tickets are taken) before the closing date, the Competition may be closed early and the draw may take place earlier than scheduled (notice of the new draw date/time will be provided). Conversely, if a Competition does not reach a minimum threshold of entries, the Promoter reserves the right to extend the competition or take other action as described in Section 4.1 and Section 6.3.

4.3 Drawing of Winner: Within a reasonable time after the Competition closes (typically within a few days, as specified by the Promoter), the Promoter will conduct a random draw to select the winner(s) of the prize from all eligible entries. The draw will include all paid entries that answered the skill question correctly (if applicable) and all valid free entries (which by mail inherently confirm the skill answer if required). The winner will be chosen at random using a fair method, such as a random number generator or a blind draw, overseen by either an independent adjudicator or a member of the Promoter’s team not involved in the entry process. The draw may be conducted live (e.g., via the Promoter’s social media channels) or recorded for transparency, at the Promoter’s discretion. All entrants have an equal chance of winning regardless of entry method. The odds of winning depend on the total number of valid entries received.

4.4 Additional Prizes: If a Competition features multiple prizes or multiple winners, the drawing process will be adapted accordingly (e.g., drawing successive winners for each prize). This will be explained in the Competition details. Unless otherwise stated, each entrant can win only one prize per Competition – if an entrant’s name/number is drawn more than once in the same Competition, the subsequent draw will be discarded and another draw will be made to ensure distinct winners for each prize.

4.5 Promoter’s Decisions: The Promoter’s decisions regarding the administration of the Competition and the drawing of winners are final and binding. No correspondence or appeals will be entered into regarding the outcome. Entrants who do not win will not generally be notified (only the winner(s) will be contacted, as described below).

5. Winner Notification and Claiming Prizes

5.1 Notification of Winner: The Promoter will attempt to contact the winner using the contact details provided at entry. If you entered online (paid entry), this will typically be by email (and possibly by phone or text message if a number was provided). If you entered by postal mail, the Promoter will contact you by email or phone (if provided in your entry letter; if not provided, the Promoter may send a notice by postal mail to the address you gave). Winner notification will usually occur within 48 hours of the draw. It is the entrant’s responsibility to provide accurate and up-to-date contact information. The Promoter is not liable if the winner cannot be notified or fails to receive the notification due to incorrect or outdated contact details, or due to emails going to spam/junk folders.

5.2 Winner Response: The winner must respond to the Promoter’s notification and claim the prize within [14] days of the initial contact (or such other timeframe as specified in the winner notification). To claim the prize, the winner will be required to verify their identity and eligibility – this may include showing proof of age, proof of identity (ID/passport), and (if requested) proof of address or other eligibility criteria. The Promoter may also ask the winner to answer a brief skill question again without assistance (as a formality required by certain jurisdictions such as Canada) or sign an affidavit/acceptance form, if necessary, to comply with local laws. These steps will be communicated to the winner.

5.3 Failure to Claim: If the winner does not respond within the required time period, or is found to be ineligible or disqualified for any reason (e.g., did not meet the entry requirements, provided false information, or violated local laws or these Terms), the Promoter reserves the right to disqualify that winner and deem their claim to the prize forfeited. In such event, the Promoter may, at its discretion, conduct a further random drawing from the remaining eligible entries to select an alternate winner, or cancel the prize award. The originally drawn winner will have no right to any prize or compensation in such case. The Promoter will make reasonable efforts to contact the alternate winner, who shall also have to respond and claim within a specified period.

5.4 Announcement of Winner: Once a winner has been successfully contacted and confirmed, the Promoter may announce the winner’s first name, last initial, and/or username and country (or county/region for UK winners) on the Website and/or TitanGiveaway social media pages. This is subject to the winner’s consent where required by law. (See Section 7 regarding publicity and personal data.) If you are the winner, the Promoter may ask if you are willing to provide a photograph or participate in reasonable publicity; this is optional but encouraged. By entering, you agree that if you win, you will cooperate in providing information needed for prize delivery/collection and in any reasonable publicity efforts.

6. Prizes

6.1 Prize Description: Each Competition will have a specific prize or prizes on offer, described on the Competition page (e.g., a particular model of car, a specific electronics item, cash amount, etc.). The prize awarded will be exactly as described for that Competition; images of prizes on the Website are for illustrative purposes only. There is no cash alternative or substitute for the prize, except as set forth in these Terms or at the Promoter’s sole discretion in exceptional circumstances (see Section 6.3). Prizes are non-transferable: the winner is not permitted to sell, auction, assign, or transfer the prize to any other person prior to receipt without the Promoter’s written consent.

6.2 Delivery of Prizes (Non-Vehicle Items): For prizes that are physical goods (such as electronics, gaming consoles, phones, etc.) other than motor vehicles, the Promoter will arrange for free delivery/shipment of the prize to the winner. If the winner is located within the UK, delivery will typically be via courier or registered post to the address provided by the winner. If the winner is located outside the UK, the Promoter will endeavor to ship the prize to the winner’s country, but any customs duties, import taxes, or additional delivery charges that may apply are the responsibility of the winner. The Promoter will liaise with the winner to coordinate shipping. The Promoter is not responsible for any delay in delivery due to customs or postal delays in the destination country. Risk in the prize (and responsibility for any insurance for the item) passes to the winner upon handover to the courier. The Promoter will provide appropriate packaging and tracking where possible. If a delivered item arrives damaged, the winner should inform the Promoter immediately so that we may pursue a claim with the courier; however, the Promoter cannot guarantee replacement of an item if damage occurred in transit (insurance will cover it if applicable).

6.3 Collection of Vehicle Prizes (Cars): For prizes that are motor vehicles (cars), the winner is required to collect the vehicle in person from the Promoter in the United Kingdom. Shipping or delivery of vehicles is not included. The Promoter will not ship the car to the winner’s country; the winner must make arrangements to travel to the UK to collect the car. The specific collection location (within the UK) and time frame will be arranged between the Promoter and the winner. Generally, the winner should arrange collection within a reasonable period (for example, within 30 days of winning, unless otherwise agreed). The winner is solely responsible for any travel expenses, accommodation, visa arrangements, or other costs required to collect the vehicle. Prior to handover, the Promoter will require the winner to show a valid photo ID and sign any necessary documents to transfer ownership of the vehicle. The winner will assume all responsibility for the vehicle upon handover, including insuring the vehicle, registering it (if necessary) in their name, paying any applicable vehicle taxes, and complying with all laws (e.g., driver’s license, driving insurance) when operating the vehicle. If the winner is unable to collect the vehicle personally, they may contact the Promoter to discuss alternative arrangements (such as authorizing a representative to collect on their behalf), but any such arrangement is at the Promoter’s discretion and may require written, notarized authorization from the winner and identity verification of the representative.

6.4 Failure to Collect Vehicle: If a vehicle prize winner fails to collect the vehicle within the agreed time and has not made alternative arrangements approved by the Promoter, the Promoter will make reasonable attempts to accommodate the winner. However, if a significant period (e.g., 90 days) passes without successful handover due to the winner’s lack of cooperation or availability, the Promoter reserves the right to deem the prize forfeited. In such case, the Promoter may dispose of the vehicle as it sees fit (including offering it to an alternate winner or using it in another promotion). The winner will not be entitled to any alternate prize or compensation if they fail to collect the prize as agreed.

6.5 Prize Substitution: In the unlikely event that the advertised prize becomes unavailable or impossible to provide (for example, if a specific model is discontinued or the item is lost/damaged before delivery, or if due to legal changes the prize cannot be awarded), the Promoter reserves the right to substitute the prize with an alternative of equal or greater value. The Promoter will make all reasonable efforts to award the prize as described, but a substitute may be necessary in some circumstances. No substitution by the winner is allowed (the winner cannot request a different prize).

6.6 Unclaimed Prizes: Any prize that is not claimed or collected in accordance with these Terms (e.g., due to winner’s failure to respond or inability to take possession) may be offered to an alternate winner or otherwise dealt with by the Promoter at its discretion (including donating the prize to charity or using it for another competition), with no liability to the originally chosen winner.

6.7 Taxes: The prize is awarded inclusive of any applicable UK VAT or taxes. The Promoter is not responsible for any taxes (including income tax) that may be payable by the winner in their country of residence as a result of winning the prize. It is the winner’s responsibility to declare and pay any such taxes and to seek tax advice if necessary. For UK winners, prizes are generally not taxable as gambling winnings (since this is a prize competition), but if the prize is a car or high-value item, any ongoing costs (car insurance, road tax) are the winner’s responsibility.

6.8 No Warranties by Promoter: The Promoter makes no representation and gives no warranty in respect of the prize’s quality, safety, or fitness for purpose, other than those provided by the manufacturer of the product (if applicable). For example, if the prize is a new electronic device or vehicle, it may come with the manufacturer’s standard warranty which will apply to the winner as the new owner. The winner agrees that the Promoter is not liable for any issues or defects with the prize itself, beyond facilitating any applicable warranty claims. All prizes are provided “as is.”

7. Data Protection and Publicity

7.1 Personal Data: By entering a Competition, you agree that the Promoter and its agents can process the personal information you provide (such as name, contact details, and any other details) for the purposes of administering the Competition. This includes using your data to register your entry, verify eligibility, contact you if you are a winner, and deliver or arrange the prize. The Promoter will handle your personal data in accordance with applicable data protection laws and the TitanGiveaway Privacy Policy (available on the Website).

7.2 Announcement of Winners: In accordance with UK advertising regulations and transparency requirements, the Promoter may publish or make available on request the surname and general location (e.g., county or country) of major prize winners. By entering, you consent to the Promoter announcing you as the winner if you win, including publishing your name on the Website and/or social media. If you object to your information being made available in this way, you must notify the Promoter when entering or at any time before the winner announcement. However, even if you object, the Promoter may still be required to provide your details (e.g., to the UK Advertising Standards Authority or other regulators) to demonstrate that a valid award took place.

7.3 Publicity: By accepting a prize, the winner agrees to participate in any reasonable publicity related to the Competition if requested by the Promoter. This may include the use of the winner’s name, photographs, videos, and a quote or interview for publicity purposes. The Promoter may wish to photograph or film the winner with the prize (especially in the case of high-value prizes like cars) and use this content for promotional announcements on the Website, social media, and other marketing materials. The winner’s consent for such publicity is appreciated and forms part of the conditions of winning. The winner will not receive any further compensation for such promotional activities, and all such materials will remain the property of the Promoter. (If a winner strongly prefers not to participate in publicity, they should inform the Promoter, and the Promoter will handle on a case-by-case basis; however, the Promoter reserves the right to reference the fact that the prize was won and by whom (name/county) as per Section 7.2.)

7.4 Use of Entries: Non-winning entries and personal data associated with them will be retained only as long as necessary for contest administration and legal purposes. The Promoter will not share entrants’ personal data with third parties for marketing purposes unless the entrant has explicitly consented to this (for example, by opting in to a newsletter). Entrants may at any time request access to or correction of their personal data held by the Promoter, or request deletion of their data (though deletion of data before the competition ends may require withdrawal from the Competition). For further details on data handling, see the Privacy Policy on the Website.

7.5 Third-Party Platforms: If the Competition is advertised or promoted on third-party platforms (such as social media sites like Facebook, Instagram, Twitter, etc.), please note that those platforms are not sponsors, endorsers, or associated with the Competition. Any information you provide is to the Promoter, not to those platforms. You hereby release any such platforms from liability in connection with the Competition. Always exercise caution when sharing personal data online.

8. Limitation of Liability

8.1 Promoter’s Liability: To the fullest extent permitted by law, the Promoter, its directors, officers, employees, and agents, assume no responsibility or liability for any loss, damage, injury, or disappointment incurred by any entrant or winner in connection with participating in a Competition or accepting any prize. By entering, you agree that the Promoter will not be liable for any indirect, special, or consequential loss or damage, or any personal or bodily injury, arising out of or in connection with your participation or any prize awarded. This exclusion does not apply to: (a) death or personal injury caused by the Promoter’s negligence, or (b) fraud or fraudulent misrepresentation by the Promoter, or (c) any other liability that cannot be excluded or limited by law.

8.2 Entry Issues: The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment or software, or failure of any email or entry to be received on account of technical problems or postal issues. Specifically, the Promoter is not liable for: (i) any entries that are lost, delayed, misrouted, corrupted, or incomplete, or cannot be delivered or entered for any technical or logistical reason; (ii) any damage or loss suffered by the entrant as a result of entering (or attempting to enter) the Competition; (iii) any errors in the announcement of prizes or dispatch of emails/letters, or (iv) any failure of the Website during the Competition (maintenance or otherwise).

8.3 Disqualification: If an entrant is disqualified or their entry is voided in accordance with these Terms (for example, due to ineligibility or rule breach), the Promoter shall have no obligation to refund any entry fees paid, except as required by law or stated elsewhere in these Terms. The Promoter shall not be liable to any entrant who is disqualified or whose entry is void for any reason.

8.4 Force Majeure: The Promoter shall not be liable for any failure to perform or delay in performing any of its obligations (including delivering a prize or conducting a draw) if such failure or delay is caused by circumstances beyond its reasonable control. This includes, but is not limited to, acts of God, war, terrorism, state of emergency, pandemic, government restrictions, fire, flood, earthquake, explosion, labor disputes, strikes, technical failure, or any other event beyond the Promoter’s control. In such events, the Promoter will make reasonable efforts to resume the Competition or fulfill obligations as soon as practicable, or to provide a reasonable alternative, but shall not incur liability for the delay or failure.

8.5 Prize Use: The Promoter is not responsible for any damage, loss, or injury sustained by the winner or any other person as a result of the use or misuse of a prize. Winners accept the prize at their own risk. For vehicle prizes, the Promoter does not provide insurance or fuel; the winner is solely responsible for safely operating the vehicle and obtaining insurance coverage from the time of collection. The Promoter will not be liable for any traffic violations, accidents, or injuries that occur once the vehicle is handed over to the winner.

8.6 Local Law Compliance: The Promoter makes no representations or warranties that the Competition complies with the laws of any country outside the United Kingdom. By entering, entrants understand and agree that they are responsible for compliance with any local laws that apply to them (as noted in Section 2.4). The Promoter shall not be liable for any entrant’s failure to comply with local legal requirements, and entrants indemnify the Promoter against any claim arising from such non-compliance.

9. General Conditions

9.1 Alteration of Terms: The Promoter reserves the right to amend these Terms (or any specific Competition rules) at any time if reasonably necessary to do so. This might include extending a Competition, changing the draw date, or making minor corrections or improvements to the Terms for clarity or legal compliance. Any changes to the Terms will be posted on the Website. In the event of a material change that adversely affects entrants, the Promoter will, if feasible, provide notice via email to current entrants and give them the option to withdraw and refund any entry fees paid.

9.2 Cancellation or Suspension: The Promoter reserves the right to cancel, terminate, modify, or suspend any Competition if it becomes necessary to do so, including if there is suspected or actual evidence of tampering or technological fraud, or any other factor beyond the Promoter’s reasonable control that corrupts the integrity or proper conduct of the Competition. If a Competition is canceled before its conclusion, the Promoter may (at its discretion) refund all paid entry fees to entrants, or resume the Competition on a new date, or distribute the prize in a fair manner among eligible entries received up to the time of cancellation. The Promoter will not be liable for any loss or disappointment incurred by an entrant due to such cancellation or modification of the Competition.

9.3 Disputes and Complaints: If you have a complaint or dispute regarding a Competition (for example, regarding winner selection or prize fulfillment), you are encouraged to contact the Promoter at office@titangiveaway.com in the first instance, and the Promoter will attempt to resolve the issue informally. In the event that a dispute cannot be resolved amicably, it will be subject to the governing law and jurisdiction set out in Section 10. The Promoter’s decision on any matter concerning the Competition is final and binding, and no correspondence will be entered into except at the Promoter’s discretion.

9.4 Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable by a court or competent authority, that provision shall be deemed deleted or modified to the minimum extent necessary, and the remainder of the Terms shall remain in full force and effect.

9.5 No Waiver: The Promoter’s failure to enforce any of its rights at any stage under these Terms does not constitute a waiver of those rights. Any waiver of a breach of these Terms will only be effective if in writing and shall not be deemed a waiver of any subsequent breach.

9.6 Third-Party Rights: A person who is not a party to these Terms (i.e., anyone who is not the Promoter or an Entrant) has no right to enforce any term of these Terms under the UK Contracts (Rights of Third Parties) Act 1999 or otherwise. This does not affect any statutory rights or any other rights that cannot be excluded by law.

9.7 Entire Agreement: These Terms, together with any specific rules or instructions on the Competition page and any applicable privacy policy or cookie policy on the Website, constitute the entire agreement between the Promoter and entrants in relation to the Competitions. They supersede any prior communications, understandings, or agreements relating to the Competitions. Entrants acknowledge that they have not relied on any representation not expressly set out in these Terms.

9.8 Language: These Terms are drafted in the English language. If they are translated into another language, the English text shall prevail in the event of any conflict or interpretation issues. Any communications from entrants to the Promoter in relation to the Competitions should be in English, where possible.

10. Governing Law and Jurisdiction

10.1 Governing Law: These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Competitions or their subject matter shall be governed by and construed in accordance with the laws of England and Wales. This choice of law is made for the benefit of the Promoter, and to the extent permitted by law, will be binding on all entrants worldwide, regardless of their country of residence.

10.2 Jurisdiction: The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Competitions or these Terms. By entering the Competition, you agree that any dispute shall be resolved in the English courts (save that if you are a consumer residing outside of England, you may also have the right to bring proceedings in your country of residence if mandatory consumer law in your country so requires). The Promoter retains the right to seek injunctive or interim relief in any jurisdiction to protect its intellectual property or confidential information.

10.3 Void Where Unlawful: Notwithstanding the above governing law, nothing in these Terms will affect any mandatory rights you may have under the law of your country of residence, if you are an international entrant. If any provision of these Terms is contrary to the law of a participant’s country, that provision shall not apply to that participant. The rest of these Terms, however, will continue to apply and the relationship between the participant and Promoter will be governed by the remaining Terms and the laws of England (to the extent legally possible).
