Terms and Conditions
Terms and Conditions
The above image is the Titan Giveaway logo, representing the Promoter of this competition. By entering this prize competition, each entrant agrees to abide by the following Terms and Conditions. These Terms outline the rules of the competition and the rights and responsibilities of participants and the Promoter.
1. Eligibility
- Age Requirement: Participants must be 18 years of age or older at the time of entry. Entry is not permitted for individuals under the age of 18. The Promoter reserves the right to request proof of age and identity from the winner; failure to provide satisfactory proof will result in disqualification and selection of an alternate winner.
- International Participation: This competition is open worldwide to entrants provided that local laws in the entrant’s country of residence do not prohibit such participation. Entries are void where prohibited by law. For example, residents of Pakistan (and any other jurisdictions where prize competitions of this nature are legally restricted or require licensing) are not eligible to enter. It is the entrant’s responsibility to ensure that they are legally allowed to participate under their own local laws.
- Personal Eligibility: Only natural persons (individual human entrants) are allowed to participate. Entries on behalf of another person or automated entries (such as via bots or scripts) are prohibited and will be disqualified. Employees, agents, and partners of the Promoter, as well as their immediate family members or household members, are not eligible to enter this competition. The Promoter reserves the right to reject any entry that it believes, in its sole discretion, does not meet these eligibility requirements.
2. Entry Methods
Paid Entry (Website): Participants may enter the Competition by purchasing tickets through the official website. Each ticket purchase will entitle the participant to a unique ticket number (entry) for the draw. There is no limit to the number of tickets an eligible individual may purchase, and each ticket counts as one separate entry. All ticket purchases must be completed before the competition closing date (as specified on the website or in these Terms). The Promoter will record and confirm each ticket entry; it is the entrant’s responsibility to ensure their purchase is successful and that they receive their ticket number(s).
-
Free Entry (No Purchase Necessary): In accordance with UK law and to ensure no purchase is necessary, the Promoter provides a free entry route. To enter for free, participants must send a postal entry on a plain postcard or letter to the Promoter’s official mailing address (as stated on the competition website). The postal entry must include the participant’s full name, a valid email address, a telephone number, and the name of the competition they wish to enter. It is recommended to print or write these details clearly in capital letters. Only one free entry per person is permitted for the competition; additional or duplicate free entries from the same individual will be disqualified. Free entries must be received by the Promoter before the competition closing date (mailing time should be considered by the entrant – late postal entries arriving after the closing date will not be accepted). Participants are responsible for the cost of postage; the Promoter will not reimburse this cost.
-
Equal Treatment of Entries: All entries are treated equally, regardless of the entry method. Entries submitted via the free postal route have an equal chance of winning as paid entries. The Promoter will assign each valid free postal entry a ticket number in the same entry pool as purchased tickets. There is no discrimination or differentiation in the drawing process between paid entries and free entries – every valid entry will be included in the random draw under the same conditions.
3. Winner Selection Process
Live Draw & Random Selection: The winner will be selected by a random draw conducted live online. The Promoter will host a live draw broadcast on its official TikTok and YouTube channels (details of the date and time of the live draw will be published in advance on the competition website). During the live stream, a split-screen display will be used: one side will show the list or range of all eligible ticket numbers, and the other side will display the Google Random Number Generator tool in real-time. The Google Random Number Generator will then be used to generate a random winning number from the pool of all ticket entries, ensuring a 100% transparent and fair selection process observable by all viewers.
-
Competition Extension: If by the initial advertised closing date of the competition less than 80% of the available tickets have been sold, the Promoter reserves the right to extend the competition deadline by 7 days. In such an event, the Promoter will make an announcement of the extension on the official competition website and/or the Promoter’s social media pages before the original closing date. All entries submitted prior to the extension remain valid and will be carried forward to the new closing date; during the extended period, additional ticket purchases and free entries will continue to be accepted. The draw will then take place at the end of the extended 7-day period under the same live, transparent conditions described above. Only one extension of 7 days is permitted for this competition – after this period, the Promoter will proceed to draw a winner regardless of the final number of tickets sold.
-
Winner Notification: The winner will be announced during the live draw by reference to the winning ticket number. After the live draw, the Promoter will also contact the winner directly using the contact information provided at entry (such as by telephone and/or email). It is the entrant’s responsibility to provide accurate and reachable contact details. The Promoter will make reasonable attempts to contact the winner within the first 24-48 hours after the draw. If the winner cannot be reached, fails to respond within 7 days of the initial contact attempt, or is found to be ineligible (for example, underage or from a prohibited jurisdiction), the Promoter reserves the right to disqualify that winner. In the event of disqualification, that individual’s claim to the prize is forfeited, and the Promoter will either conduct a new random draw from the remaining eligible entries to select an alternate winner or award the prize to the next runner-up as deemed fair and appropriate by the Promoter.
-
Promoter’s Decision Final: The random draw result is final and binding. The Promoter’s determination of the winner (and any alternate winner, if applicable) shall be conclusive. No correspondence or appeals will be entertained regarding the outcome of the draw or the competition. Entrants agree that the competition results are purely based on chance (for random draws) and the methodology disclosed, and therefore waive any right to challenge the outcome, provided the draw is conducted substantially as described in these Terms.
-
Winner Publicity: By entering the competition, each participant agrees that if they win, the Promoter is permitted to announce the winner’s name (typically, first name and maybe the initial of last name) and general location (town/country) publicly. The winner’s name and location may be published on the Promoter’s website, social media pages, and/or announced during the live draw for transparency. The winner may be asked to participate in publicity activities related to the competition – for example, being photographed with the prize or providing a short testimonial. By accepting the prize, the winner consents to the use of their name, likeness, and any statements for advertising and promotional purposes in connection with this competition without additional compensation, except where prohibited by law. The Promoter will not use the winner’s information in a way that is excessively intrusive and will handle any personal data in accordance with the privacy provisions below.
4. Prize Collection & Alternatives
Prize Collection (In-Person): The winner is required to collect the prize in person at a location and time in the United Kingdom specified by the Promoter (unless otherwise agreed in writing by the Promoter). The prize (which will be described in the competition details – e.g., a specific vehicle or item) will not be shipped or delivered by the Promoter by default; personal pickup is mandatory to ensure secure handover and proper verification. Upon collection, the winner must present valid government-issued photo identification (such as a passport or driver’s license) that matches the name of the winning entry. The Promoter may also require the winner to present their winning ticket number confirmation (as provided by email or entry receipt). The winner is solely responsible for any travel arrangements and costs incurred to travel to the pick-up location to claim the prize. The Promoter will coordinate with the winner to arrange a suitable appointment for prize handover, and the winner must collect the prize within 30 days from the date of winner confirmation (unless an alternative arrangement is agreed upon). Failure by the winner to collect the prize within the stipulated time frame (and absence of any agreed extension) may result in forfeiture of the prize, in which case the Promoter reserves the right to select an alternate winner (as described above) or to dispose of the prize at its discretion.
-
Cash Alternative: If a cash alternative is offered for the prize (as either a designated alternative in the competition details or at the Promoter’s discretion), the winner may choose to receive the cash prize instead of the original prize. The availability and amount of any cash alternative will be specified by the Promoter (for example, a set monetary amount in GBP). Should the winner opt for the cash alternative, they must provide the Promoter with valid bank account details (in the winner’s name) to facilitate an electronic bank transfer. The Promoter will transfer the cash prize to the winner’s provided bank account within a reasonable time (typically within 14 days) after receiving the necessary bank information and after completing any winner verification processes. No other prize alternatives or substitutions will be offered except as described in these Terms. The prize (whether the original item or the cash alternative) is non-transferable; it can only be awarded to the winning entrant and cannot be assigned or given to another person. The winner cannot request a different alternative prize, and no part of the prize is exchangeable for any other benefit, except at the Promoter’s sole discretion.
-
Prize Substitution: In the event that the advertised prize becomes unavailable or cannot be awarded as described (due to circumstances beyond the Promoter’s control, such as prize item damage, loss, or a supplier issue), the Promoter reserves the right to substitute the prize with another prize of equal or higher value. The Promoter will make every reasonable effort to provide a prize that is as similar as possible to the original prize description. No cash alternative will be offered in such circumstances unless it is offered to all participants (or unless the Promoter, at its sole discretion, chooses to offer a cash substitute). The winner will not be entitled to any additional compensation or claim of any kind if a replacement prize is provided. The Promoter will communicate any prize substitution to the winner upon or prior to winner notification.
-
Taxes and Duties: The responsibility for any taxes, duties, or charges payable on the prize (for example, income tax in the winner’s country, or import duties if the winner is from outside the UK and chooses to transport the prize to their home country) lies with the winner. The prize is awarded on the basis that it is a gratuitous lottery/competition win, and no VAT or sales tax is charged by the Promoter on ticket sales (if applicable) or on the prize. The winner is solely responsible for reporting the prize to their local tax authorities if required and for paying any applicable taxes or fees. The Promoter assumes no responsibility for any tax implications or additional costs associated with the prize once it has been collected by the winner. Winners are advised to seek independent financial advice regarding any tax liabilities that may arise from winning the prize.
5. Refund & Cancellation Policy
No Refunds: All ticket sales and competition entries are final. Once an entry (ticket purchase or free entry) has been submitted, no refunds will be provided under any circumstances. This no-refund policy applies equally to all entrants and for all reasons, including (but not limited to) an entrant changing their mind about participation, an entrant’s failure to utilize or attend the draw, or an entrant’s disqualification for violating these Terms. Entrants acknowledge that the purchase of a competition ticket is a payment for the opportunity to participate in the prize draw, and no reimbursement shall be due if the entrant is unsuccessful or if the competition process is extended (as described below). By entering, participants accept that they are not entitled to a refund of entry fees even if the competition schedule or draw date is adjusted, as long as a valid winner is eventually drawn and awarded the prize.
- No Cancellation of Competition: The competition will not be canceled by the Promoter once it has launched and tickets have been sold, except in the most extreme circumstances which render the completion of the competition genuinely impossible (e.g., a legal injunction or events beyond the Promoter’s control – see “Limitation of Liability” below). In particular, the Promoter will not cancel the competition due to low ticket sales. Instead of cancellation, if ticket sales are below expectations, the competition period will be extended by 7 days as detailed in Section 3 above, rather than terminated. All participants understand and agree that the Promoter’s commitment is to proceed with the competition and award the advertised prize (or an appropriate substitute, as outlined in these Terms) irrespective of the number of tickets sold. In the unlikely event that an unavoidable cancellation is required (for instance, by law or government order), the Promoter will communicate the cancellation to all participants and may issue refunds or take other remedial actions at its discretion, but such a scenario is beyond the standard scope of these Terms (which assume the competition will run to completion).
6. Legal Jurisdiction & Dispute Resolution
-
Governing Law: This prize competition, and any dispute or claim arising out of or in connection with it (including the prize, entry process, or these Terms and Conditions), shall be governed by and construed in accordance with the laws of England and Wales, United Kingdom. These Terms are subject to all applicable laws and regulations in the UK, and by entering, participants agree that the competition is compliant with UK laws governing prize competitions. If any provision of these Terms is found to be invalid under any applicable law, it shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
-
Jurisdiction: Any disputes or disagreements arising from or related to this competition or these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. By entering the competition, participants irrevocably agree that such courts shall have exclusive authority to settle all disputes. The Promoter and all entrants waive any right to argue that the chosen courts are not the appropriate venue or that they do not have jurisdiction over the dispute. In the event of a dispute, entrants are encouraged to contact the Promoter first to seek an amicable resolution before pursuing legal action. Nothing in these Terms affects any statutory rights that entrants may have as consumers.
7. Data Protection & GDPR Compliance
-
Personal Data Collection: By participating in the competition, entrants consent to the Promoter collecting and processing their personal data for the purposes of the competition. The personal information collected may include (but is not limited to) the entrant’s full name, email address, phone number, and (if necessary) a postal address (for instance, if needed for prize delivery or identity verification). For entrants using the free postal entry route, the information provided in the postal submission will likewise be recorded. This personal data is collected solely for the administration of the competition, which includes verifying eligibility, assigning ticket numbers, contacting winners, and delivering prizes. The Promoter will not use entrants’ personal data for marketing purposes unless the entrant has explicitly opted in to receive marketing communications. Entering the competition will not automatically subscribe the entrant to any newsletters or marketing lists.
-
Data Security & Usage: The Promoter is committed to protecting entrants’ personal data and complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. All personal data obtained in connection with this competition will be stored securely and handled in accordance with the Promoter’s Privacy Policy (available on the official website). The Promoter will not share, sell, or disclose entrants’ personal information to any third parties except as is necessary for running the competition (for example, using a third-party email service to send winner notifications, or providing the winner’s details to a prize supplier for direct prize collection if applicable). Any third-party service providers involved in the competition will also be bound by data protection obligations. The Promoter will retain personal data of participants only for as long as necessary to complete the competition and award the prize, and for a reasonable period thereafter as required for legal and accounting purposes (such as keeping records of the promotion and winners as required by law or regulatory bodies). After this period, personal data that is no longer needed will be securely deleted or anonymized.
-
Entrants’ Rights: Under GDPR, entrants have certain rights regarding their personal data held by the Promoter. These rights include the right to request access to their data, the right to correct any inaccuracies in their data, the right to request deletion of their data, and the right to object to or restrict processing in certain circumstances. Entrants may exercise any of these rights by contacting the Promoter at the designated contact email or address provided on the competition website (or in the Privacy Policy). Upon request, and once the identity of the requester is verified, the Promoter will provide information about the data held about that person or take reasonable action to comply with the request (as applicable and within the timeframes stipulated by law). Please note that if an entrant requests deletion of their data before the competition concludes, this will be treated as a withdrawal from the competition, since the Promoter will no longer be able to contact the entrant or verify their entry. Except for winner information (which may be retained as required by law and for winner announcements), all entrants’ personal data will be processed in line with participants’ privacy rights. For further details on how the Promoter handles personal information, please refer to the full Privacy Policy on the Promoter’s website.
8. General Conditions & Liability
-
Limitation of Liability: To the fullest extent permissible by law, the Promoter, its directors, employees, agents, and affiliates shall not be liable for any loss, damage, injury, or disappointment suffered by any entrant participating in the competition or as a result of accepting or using any prize. By entering, each participant agrees that the Promoter is not liable for any indirect, incidental, special, or consequential damages, or any loss of profits, revenue, or goodwill. Nothing in these Terms excludes or limits the Promoter’s liability for death or personal injury caused by the Promoter’s negligence, or for any other form of liability that cannot be legally excluded or limited. However, by accepting these Terms, entrants agree that, to the extent permitted by law, the Promoter’s total liability in respect of any claim arising out of or in connection with this competition (whether in contract, tort, or otherwise) shall be limited to the cost of the ticket purchased (if any) or the equivalent monetary value.
-
Technical Issues & Force Majeure: The Promoter is not responsible for any entries that are lost, delayed, misdirected, or incomplete, or for any technical problems or human error that may result in an entry not being received or not being included in the draw. This includes, without limitation, failures of the website, network, server, hardware or software, or postal service errors that might affect the communication or receipt of entries. Proof of transmission or posting is not proof of receipt of entry by the Promoter. The Promoter will not be liable for any failure to perform or delay in performing any of its obligations if such failure or delay is caused by circumstances beyond its reasonable control (force majeure events). In the event that any part of the competition (including the live draw) is hindered by a technical failure or unforeseen event, the Promoter will make reasonable efforts to resume or reschedule the competition to ensure a fair outcome. Entrants will be informed of any material changes via the competition website or by email.
-
Disqualification & Entry Rejection: The Promoter reserves the right, at its sole discretion, to disqualify or refuse entry to any individual found to be tampering with the entry process or the operation of the competition, or to be acting in violation of these Terms and Conditions. This includes (but is not limited to) entrants using multiple identities, entering from multiple accounts or email addresses to exceed entry limits, submitting false or misleading information, or engaging in any fraudulent or illegal activities in connection with the competition. If any entrant is disqualified for any reason, they will be ineligible to win the prize, and if they are determined as the winner before the discovery of the violation, the Promoter will declare that result void and will perform a new draw to select a legitimate winner. The Promoter’s decision to disqualify an entrant is final and conclusive. No correspondence will be entered into regarding the disqualification.
-
Amendments to Terms: The Promoter reserves the right to amend or update these Terms and Conditions at any time if it becomes necessary to do so (for example, to address errors, to ensure compliance with applicable law, or to clarify provisions). In the event of any amendment, the Promoter will post the revised Terms and Conditions on the official competition website and/or notify entrants of the changes via email (if appropriate). Continued participation in the competition after any such update constitutes acceptance of the revised Terms. If an entrant does not agree to the revised Terms, they should contact the Promoter to withdraw from the competition (in which case, if the competition is still ongoing, the Promoter may refund the entry fee at its discretion). However, no amendment will retroactively affect entries already made or rights already accrued by entrants, and any changes will only apply from the date of implementation forward.
-
Severability: If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining Terms, which will continue to be valid to the fullest extent permitted by law. The invalid provision shall be interpreted, if possible, in a manner that most closely reflects the original intent of the Promoter as expressed in these Terms.
-
Acceptance of Terms: By submitting an entry into the competition (whether by purchasing a ticket or by using the free entry route), all participants are acknowledging that they have read, understood, and agree to be bound by these Terms and Conditions. The Promoter recommends that you print or save a copy of these Terms for your records. These Terms constitute the entire agreement between each entrant and the Promoter with respect to the competition and supersede any other communications, statements, or promotional materials related to the competition. If you do not agree with any part of these Terms, please do not enter the competition.
-
